Unnecessary Injuries to Loved Ones

An unfortunate side effect of the Baby Boomer generation has resulted in an increase in individuals that are in full nursing home care facilities. There are state and federal laws that govern the level of care that must be provided to those that are residing in a nursing home or managed care facility. We at the law firm of Moss ◊ Hovden are dedicated to representing the rights of elderly and incapacitated individuals that have been injured as the result of nursing home abuse or neglect. If you have a loved one that has sustained a nursing home injury, contact our office today for a free initial consultation with an experienced personal injury lawyer.

Nursing Home Neglect Injuries

Neglect is the failure to care for a person in a manner which would avoid harm and pain or the failure to react to a situation which may be deemed harmful. It is possible for neglect to be intentional, but it frequently is not. Injuries from neglect can be life-threatening and require extensive medical care. Some of the types of injuries that often result from neglect include:

  • Bedsores (also known as pressure sores, pressure ulcers or decubitus ulcers)
  • Broken bones and head injuries from falls
  • Illness from medication errors
  • Untreated illnesses
  • Severe dehydration
  • Malnutrition

Neglect can be the result of too high of a patient-to-staff ratio or the improper training of individuals providing care, among many other reasons for neglect. Regardless of the reason, neglect should never be tolerated and action should be taken to see that no neglect is committed in the future.

Nursing Home Abuse Injuries

Unlike neglect, which can be unintentional or intentional, abuse is definitively intentional. The intentional causing of pain or harm is considered abuse. It can be physical, mental, verbal, psychological or sexual, and can include intimidation, corporal punishment and unreasonable seclusion. Some examples of abuse injuries can include:

  • Sores from excessive restraint
  • Memory or functional problems from oversedation
  • Broken bones (fractures), abrasions and lacerations from punishment
  • Fears and emotional distress
  • Loss of trust
  • Bruising, cuts and abrasions from sexual assault

Abuse injuries that are mental, psychological or emotional may never heal. Elderly individuals are particularly vulnerable to extended distress. We handle abuse cases extremely aggressively, as no one's health, safety and well-being should ever be at risk and never taken advantage of.

Wrongful Death

Unfortunately, a situation where there has been nursing home neglect or elder abuse may result in the death of an individual. This death would be deemed a wrongful death if it was due to the neglect or abuse and was preventable. Our firm is dedicated to holding the negligent or abusive parties responsible for the death by filing a wrongful death lawsuit and pursuing compensation for the losses.

No one should have to deal with the nursing home injuries that a loved one has suffered. Let our experienced attorneys, Rodney Moss and Del Hovden, help you take immediate action to stop the abuse or neglect and seek justice.
